Terms of Use

 

These Terms of Use govern your access to and use of imei’s website at imei.com.au (the Website), operated by imei Pty Ltd (ABN 16 095 165 576) (imei, we, us, our). Please read them before using the Website.

 

1. About these terms

By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.

These terms apply to your use of the public Website only. They do not govern the imei 360 portal or the supply of imei products and services – see clause 9.

We may update these terms from time to time. The version published on the Website applies from the date it is posted, and your continued use of the Website after a change means you accept the updated terms.

 

2. Who we are

The Website is operated by imei Pty Ltd (ABN 16 095 165 576), Level 4, 18 Aquatic Drive, Frenchs Forest NSW 2086, Australia. Our contact details are in clause 14.

 

3. Using the Website

You may access and use the Website for lawful purposes and to learn about imei’s products and services. When using the Website, you must not:

  • use the Website in breach of any law, or for any unlawful, misleading or harmful purpose;

  • interfere with or disrupt the Website, the servers or networks that host it, or its security or integrity;

  • attempt to gain unauthorised access to any part of the Website, or to any account, system or network connected to it;

  • introduce any malware, or probe, scan, penetration-test or reverse-engineer the Website, except to the extent this restriction cannot lawfully be excluded;

  • use any automated means (such as scraping or harvesting) to access the Website or extract data, except through interfaces we expressly provide; or

  • use the Website to store or transmit any unlawful, infringing, defamatory or otherwise harmful material.

 

 

4. Intellectual property

The Website and its content – including text, graphics, logos, images, layout and design – are owned by imei or its licensors and are protected by intellectual property laws.

We grant you a limited, revocable, non-exclusive licence to view the Website and to print or download extracts for your own personal, non-commercial reference. You must not otherwise reproduce, republish, distribute, modify or commercially exploit any content from the Website without imei’s prior written consent.

“imei”, the imei logo and the “Intelligent Connectivity” tagline are trade marks of imei and must not be used without our prior written consent.

 

5. Material you submit

If you submit information through the Website – for example, through contact, enquiry or download forms – you must ensure it is accurate and that you are entitled to provide it. You must not submit unlawful, infringing or harmful material, or another person’s personal or sensitive information without authority. We handle personal information you provide in accordance with our Privacy Policy (see clause 10).

 

6. Information on the Website

The content of the Website – including guides, whitepapers, articles and blog posts – is provided for general information only and is not professional, technical, legal or financial advice. While we take reasonable care to keep information accurate and current, we do not warrant that it is complete, accurate or up to date, and you rely on it at your own risk. You should obtain advice specific to your circumstances before acting on anything on the Website.

 

7. Website availability

We aim to keep the Website available, but we provide it on an “as is” and “as available” basis and do not guarantee that it will be uninterrupted, secure or error-free. We may change, suspend or withdraw all or part of the Website at any time without notice.

 

8. Third-party links and content

The Website may contain links to third-party websites, content or services. We provide these for your convenience only. We do not endorse, and are not responsible for, the content, products, services or privacy practices of any third-party site. Your access to and use of those sites is at your own risk and subject to their own terms.

 

9. imei 360 portal, products and services

The Website does not process orders or take payments. Ordering, account management and transactions take place in the imei 360 portal.

Access to and use of the imei 360 portal is governed by the imei 360 Portal Terms of Service, and the supply of imei products and services is governed by your separate agreement with imei (for example, a Master Services Agreement). Nothing on the Website, and nothing in these terms, varies those arrangements.

 

10. Privacy

imei handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains how we collect, use, disclose and protect personal information – see imei.com.au/privacy-policy.

 

11. Disclaimers and your consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to those rights, and to the extent permitted by law, imei excludes all other warranties, representations and guarantees in connection with the Website and its content.

 

12. Limitation of liability

Subject to your rights under the Australian Consumer Law and other rights that cannot be excluded, and to the extent permitted by law, imei is not liable for any loss or damage (including indirect, special or consequential loss, or loss of data, profits or business) arising out of or in connection with your use of, or inability to use, the Website, its content, or any third-party site accessed through it.

 

13. Governing law and jurisdiction

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
